Individuals & Families

Campbell Partners LLP understands that many individuals work during the week and are unable to meet during the day. Some of our lawyers will meet with you during the evening or even on the weekend if your schedule will not allow appointments during the day. At Campbell Partners LLP we listen, synthesize information, provide you with sound options, and execute on our plans.

Wills, Estates & Trusts

Estate planning should begin well before an individual's later years in life. Planning for the future is important and Campbell Partners LLP can help you by drafting wills, powers of attorney, and trusts that reflect your intentions. We also help protect your rights as a beneficiary of an estate, or assist you as an executor of an estate by providing information, negotiation and litigation necessary to protect your interests and ensure the proper distribution of an estate.

Will Planning and Powers of Attorney

A properly drafted will is key to ensuring an easy distribution of your possessions once you have passed. Without a will, or with a poorly drafted will, your family will have to decide what you would have done in the event that you had a will. This may result in bitter family disputes and quarrelling, in addition to costly legal fees. Campbell and Associates can help you plan your estate and draft your will accordingly. We can also help you set up a power of attorney to manage your property or your personal care, in the event that you become incapacitated.

Trusts

In situations involving a family business or substantial assets, you may wish to utilize a trust for your holdings. Considerable tax benefits exist in setting up a family trust or business trust, which can prevent passing on a tax burden to your loved ones and Campbell Partners LLP is pleased to work with you to develop your estate plan If you have a family member with a disability, Campbell Partners LLP can help plan your estate with their special needs in mind and ensure that you implement the trusts necessary to ensure their ongoing support after your death.

Estate Distribution and Litigation

If you have been appointed an executor under a will, or if no will exists and you are questioning whether you should be the executor or whether you may have a claim against the estate, we can help you navigate the process of distributing an estate.

If you are presently in a dispute over an estate, have a claim against an estate, or if you are unsure of your entitlement under an estate, Campbell Partners LLP can help you understand your rights and the process involved in distributing the estate and potentially disputing an estate distribution.

Residential Real Estate

There are many terms floating around in the market place concerning the purchase and sale of home in Ontario: Ontario New Home Warranty Program, Title Insurance, Conveyancers, and the list goes on. At Campbell Partners LLP we can explain these terms to you, how they apply to your particular situation, and allow you to make an informed choice concerning a purchase or sale of a home or condominium.

Resale Homes

In today's hot housing market it is important to have attentive eyes on the details. The Agreement of Purchase and Sale used to transfer your property is a complex and legally binding document. An improperly written contract can allow the purchaser to void the sale, or cost you thousands of unnecessary dollars. Conversely, if you are the purchaser, a lawyer can ensure that you get what you pay for and prevent surprises, like getting the 20-year old fridge that you saw in the basement rather than the new steel Kitchen Aid in the kitchen!

New Homes

The purchase of a new home is an exciting time for any buyer. Builders often allow for a range of colours, styles, and finishings, all selected by the buyer. Having a lawyer review your New Home Agreement of Purchase and Sale will ensure that you get the particular upgrades and finishing touches that you deserve. Additionally, having a lawyer involved at all stages during your purchase of a new home can prevent unnecessary and costly surprises.

For example, if the builder does a miscalculation with respect to the grading of your house and your patio door ends up several meters off the ground rather than at ground level, you would be responsible for the installation of a deck. Failure to install the deck may render your house uninhabitable pursuant to municipal by-laws. Having a lawyer review and in some cases insert special clauses in the Agreement of Purchase and sale can prevent such a costly and time-consuming process.

Condominiums

Buying and/or selling a condominium is a unique process. Having a lawyer at your side to see you through from the offer to closing is essential. Condominiums are governed by the by-laws in the condominium and run by a Board of Directors. These details are important to any prospective purchaser of a condominium because certain by-laws may restrict alterations to the condominium unit, determine maintenance fee schedules, and other rights and responsibilities of a unit occupier. Once again, Campbell Partners LLP can make sure that when you purchase your condominium, you are aware of all of the benefits attached to a particular unit and avoid unnecessary pitfalls.
