Litigation & Administrative Actions

Litigation is a broad term, which includes any action that may be brought before a court. At Campbell Partners LLP we believe in effective and timely representation of our clients’ cases. Our versatility works to your advantage because it allows us to consider each case individually with fresh ideas. Campbell Partners LLP takes pride in its versatility and the creative solutions developed for our clients. We strive to seek resolutions in cases, which are fair but advantageous to our clients’ interests with the costs of litigation in mind. However, we bring the same tenacity, backed by a sound litigation strategy and thorough research of the law, to trial.

Our lawyers regularly appear before judges of the Ontario Court of Justice, Superior Court of Justice and have appeared before the Court of Appeal for Ontario. We have acted for clients before a number of provincial and federal administrative tribunals including the Ontario Human Rights Tribunal, Social Benefits Tribunal, Ontario License Appeal Tribunal, Discplinary bodies of various professional colleges, the Canadian International Trade Tribunal, Workplace Safety and Insurance Tribunal, to name a few.

Administrative Actions

Areas of Administrative Law practice include judicial reviews of appropriate cases before the Superior Court of Justice (Divisional Court) and appearances on behalf of clients before government review boards, tribunals and professional disciplinary committees. Some Administrative Law proceedings are quasi-criminal in nature and can have significant repercussions in the form of a jail sentence or substantial fine. Others involve an important human rights component such as the supply of essential educational or special needs services. Often, the decisions made by officials at government or regulatory institutions are outside their discretion or an improper exercise of such discretion.

Administrative proceedings include but are not limited to the following:

  • Disciplinary proceedings under professional licensing bodies including but not limited to the following: College of Physicians and Surgeons Ontario, College of Nurses of Ontario, Professional Engineers Ontario (Association), Law Society of Upper Canada, Ontario Pharmacists’ Association, Institute of Chartered Accountants Ontario, Royal College of Dental Surgeons of Ontario, and the Real Estate Council of Ontario.
  • Tribunal hearings before the Ontario Human Rights Tribunal, Health Services Appeal Board, Ontario Municipal Board, Criminal Injuries Compensation Board, Workplace Safety and Insurance Appeals Tribunal and the Pay Equity Commission, to name a few.

If you believe that you have been incorrectly denied a service or are facing a prosecution under an administrative or regulatory body, Campbell Partners LLP can help.
